Court orders arrest of Midiwo, over Raila assassination claims

The High Court in Kisumu has requested the capture and arraignment of Gem MP Jakoyo Midiwo for guaranteeing that CORD pioneer Raila Odinga's life was in risk three years back.

Equity Hillary Chemitei rejected an application by the National Assembly Minority Chief Whip that had tested an offered by the Director of Public Prosecutions (DPP) to capture him over the cases.

Midiwo made the death claims in a burial service in Bondo on April seventh, 2012 that Raila Odinga's life was in risk.

For his situation, Midiwo had requested that Justice Chemitei suppress the capture warrant by the DPP saying he ought not be captured but rather complimented for blowing the shriek on the plot to kill the CORD pioneer.

In any case, the DPP, through State Counsel James Warui told the court that Midiwo had neglected to substantiate his case and had made the death plot comments to increase political mileage.

In his decision on Monday, Justice Chemitei said the CORD MP had not demonstrated his case.

"It is my finding that the applicant has neglected to exhibit that the expected arraignment was driven by another reason other than equity and implementation of the law. The same is thus rejected with expenses to the respondents," ruled Justice Chemitei.
