The Coalition for Reforms and Democracy (CORD) Members of Parliament and University on nairobi Leader Babu Owino have moved to High Court looking to be Released on Bail as test into claimed Hatespeech discourse comments they made proceed.

The officials, among them Senator Johnstone Muthama (Machakos), Kilifi Women Representative Aisha Jumwa, Timothy Bosire (Kitutu Masaba), Florence Mutua (Busia Women Representative) and Junet Mohamed (Suna East) close by the University of Nairobi Student Leader Babu Owino need the decision by the Milimani Magistrate Court remanding them until Friday without a Bail or security choice turned around. In the application, the six contend that the court misapplied and improperly invoked the provisions of Article 49(1)(h) of the Constitution on the inquiry with reference to whether there existed adequate grounds to hold or keep them pending further examinations or charge.
They contend that the Chief Magistrate Court denied them bail and ordered they be confined for four days pending examinations which sum to an infringement of their sacred rights. The six further case that inspite of being held in care for 18 hours, they have not been permitted any sustenance nor access to their attorneys, life partners or relatives.
The officials were summoned on Tuesday before the Nairobi Chief Magistrate Court close by Jubilee MPs Moses Kuria (Gatundu South), Ferdinand Waititu (Kabete) and Kimani Ngunjiri (Bahati) yet did not reply to any charges after the indictment connected for their detainment pending examinations. The Inspector General of Police, the Directorate of Criminal Investigations and the workplace of the Director of Public Prosecutions have been named as respondents.
